CHAPTER 35. An ACT to erect and establish the county of Anderson out of parts of the county of Franklin, Washington and Mercer. Approved January 16, 1827.
SECTION 1. BE it enacted by the General Assembly of the Commonwealth of Kentucky, That from and after the first day of February next, all that part of the counties of Franklin, Mercer and Washington, included within the following boundaries, to-wit: Beginning at the mouth of Little Benson creek, on Kentucky river, in Franklin county; thence with the meanders of said creek, to Brock’s spring, near the Harrodsburg road; thence on a straight line to Caleb Tinsley’s, leaving him in Franklin county; thence by a line due west to the line of Shelby; thence along the same, to the mouth of Crooked creek, on Salt river; thence along the dividing line of Washington and Nelson, to the mouth of Beaver creek, on Chaplin’s fork of Salt river; thence up said creek, to where the road from Springfield to Frankfort crosses the same; thence with a line east, so as to leave Vincent Morgan in Washington county, to the dividing line between Washington and Mercer; thence with the Washington and Mercer line, to a point from which a line due east, will include the house of James Downey; thence a straight line, to include the house of Thomas Hardisty, on the Harrodsburg road; thence a straight line to the Kentucky, at the ferry of Costello Dawson, Sr.; thence down the river, to the beginning—to be one and a distinct county, called and known by the name of Anderson county; in honor of the late Richard C. Anderson, Jr.
SECTION 2. The courts of said county of Anderson, shall be held on the first Monday in every month; except that there shall not be a County Court held in said county, in the months in which Circuit Courts are held.
SECTION 3. The said county shall be attached to the fourth judicial district; and the Circuit Courts therein shall be held on the fourth Mondays in the months of January, July and November; which may continue six days each term, if necessary; with such powers, and in such manner as is provided by law in respect to other Circuit Courts.
SECTION 4. Process shall issue and be made returnable as heretofore; and the several courts of the counties out of which this county is erected and established, shall have cognizance of all matters of controversy, at law or in equity, until the first day of February next; at which time, all power and jurisdiction shall cease and determine. Provided, that all suits or actions commenced in either of said original counties, shall be tried and determined therein respectively.
SECTION 5. That there shall be allowed ten justices of the peace for said county of Anderson, to be commissioned by the Governor, according to the provisions of the constitution.
SECTION 6. The justices of the peace for the said county of Anderson, shall meet at the house of William Hudgins, in the town of Lawrence, (which shall hereafter be called and known by the name of Lawrenceburg), in said county, on the first court day after this act shall take effect; and having taken the oaths prescribed by the constitution and laws of this state, shall proceed to appoint and qualify a clerk.
SECTION 7. It shall be the duty of the several sheriffs of the respective counties of Franklin, Mercer and Washington, to levy executions and make distress, in all cases founded upon a judgment of record, for all public dues or officers fees, unpaid by the inhabitants of said county of Anderson, at the time the said county shall go into operation; and the said sheriffs shall be accountable in the same manner as though this act had not been passed.
SECTION 8. The Governor shall commission a suitable person, resident within the said county of Anderson, as sheriff thereof.
SECTION 9. BE it further enacted, That William Trotter, of Franklin county, R. D. Shipp, of Woodford county, Joel P. Williams, of Mercer county, Stephen Lee, of Washington county, William T. Webber, of Shelby county, and E. Kincheloe, of Nelson county, be, and they are hereby appointed commissioners, (any five of whom may act), to locate the seat of justice for the county of Anderson. They shall assemble at the house of William Hudgins, in the month of March or April next, and having taken an oath faithfully to perform the duties assigned them, shall proceed to select a site for the seat of justice for said county; and report thereon to the County Court of said county; and they shall be entitled to two dollars per day for their services.
SECTION 10. The said county of Anderson shall be entitled to five constables, to be appointed by the County Court thereof; and the sheriff and constables aforesaid shall enter into bond and security, in the office of the clerk of said county, according to law.
SECTION 11. The County Court of said county of Anderson may, at their March, April or May terms, proceed to levy a tax or county levy on the inhabitants thereof, for the purpose of defraying the county expenses, and of erecting buildings; which may be done as soon thereafter as the said County Court may think proper. Provided, that nothing herein contained, shall in any wise affect the collection of the tax and levies laid by the respective County Courts of Franklin, Mercer and Washington, for the year one thousand eight-hundred and twenty-six.
SECTION 12. And be it further enacted, That until the public buildings are erected, the Circuit and County Courts of said county shall hold their respective courts at the house of William Hudgins, in the town of Lawrenceburg.
SECTION 13. This act is not to take effect until the twentieth day of January next; except that the sheriff and justices of said county may be commissioned from and after the passage thereof.
SECTION 14. BE it further enacted, That Willis Blanton, of Franklin county, William M. Bell, of Washington county, and Peter R. Dunn, of Mercer county, be and they are hereby appointed commissioners, any two of whom may act, and may proceed, as soon as practicable, to run and mark the boundary lines of the said county of Anderson; and when run and marked as aforesaid, said commissioners shall make out four fair plats of the said boundary, one of which shall be transmitted to the County Court of Anderson, and one each to the County Courts of Franklin, Mercer and Washington. The said commissioners shall receive each two and a half dollars per day, to be paid by the county of Anderson.
SECTION 15. BE it further enacted, That the free voters of said county shall vote as heretofore in their several counties and precincts, as though this act had not passed, until the next apportionment of Representatives.
